This only struck me after I'd posted the above responses and had a chat with someone. Replace #4 with:

They saw the ship go down, but Captain Jack Sparrow didn't really die that day. The Kraken took him, true enough, but he defeated the Kraken by eating his way out its side. It consequently died a slow, hemmorrhage-y death and Captain Jack was turned off calamari for life.
